Welcome to the Gut Health Reset Program (the “Program”) with Above Health, LLC (“Above Health”). We are excited to support you in your journey to better gut health through this comprehensive program. Below are the terms of this “Agreement” to outline the roles, responsibilities, and expectations for your participation in the Program. Please read carefully to ensure clarity and alignment for a successful experience.
By enrolling in the Program, you agree to the following terms:
1. Program Description
The Program is a guided, online program designed to help you relieve digestive symptoms, reduce inflammation, and restore balance through foundational gut health principles.
The Program Includes:
- Access to online video courses and resources for a total of 8 weeks, starting from the beginning of Prep Week.
- Downloadable tools and materials to support your gut health journey.
- Weekly live coaching sessions for guidance, Q&A, and accountability.
- Membership in a private, supportive community.
2. Investment and Payment Terms
Investment:
By enrolling, you confirm that you are financially willing and able to invest in the Program and that doing so will not cause financial hardship.
Payment Authorization:
Upon payment, you will receive an electronic receipt confirming your enrollment.
Refund Policy:
Due to the extensive time, effort, and resources invested in creating this Program, all sales are final, and no refunds will be issued. By enrolling, you acknowledge and agree to this Refund Policy and waive your right to initiate a chargeback for payments made. Should you attempt a chargeback, this Agreement will terminate immediately, and you remain responsible for full payment of the Program.
3. Program Access and Supplement Suggestions
Account and Access:
Upon enrollment, you will receive an email with instructions to create your account through Kajabi. This account will provide access to all course content, resources, and the private community. Access to the Program begins during Prep Week and extends for a total of 8 weeks.
Supplement Suggestions:
The Program includes guidance on optional supplements to support gut health. All supplement recommendations are for informational purposes only and should be discussed with your healthcare provider before use.
4. Intellectual Property Rights
All materials provided in the Program, including video content, downloads, and resources, are the intellectual property of Above Health, LLC. You are granted a single-user license for personal use only and may not copy, distribute, reproduce, or share these materials without prior written consent.
Violation of these terms may result in legal action, and Above Health will pursue all available remedies under intellectual property laws to protect its materials.
5. Personal Responsibility, Disclaimer & Release of Claims
No Guaranteed Outcomes:
The Program provides tools and guidance to support your gut health, but individual outcomes may vary. Above Health does not guarantee specific results, as success depends on individual circumstances and effort.
Assumption of Risk:
By participating, you accept full responsibility for your choices, actions, and results before, during, and after the Program. Above Health is not liable for your physical, mental, emotional, or spiritual health outcomes related to your participation.
Limitation of Liability and Release of Claims:
You agree to hold harmless and release Above Health, its owners, employees, and affiliates from any and all liability, claims, or damages arising from your participation in the Program, to the fullest extent permitted by law.
6. Other Important Terms
Termination:
Above Health reserves the right to terminate this Agreement at any time. Should you terminate your participation, you remain financially responsible for the full cost of the Program.
Notice:
All communications regarding this Agreement should be sent via email to Hello@AboveHealthnutrition.com.
Force Majeure:
Above Health is not liable for delays or inability to fulfill obligations under this Agreement due to unforeseen events such as natural disasters, pandemics, or other acts beyond reasonable control.
Dispute Resolution:
In the event of a dispute, both parties agree to binding arbitration in the County of Suffolk, Massachusetts. The arbitrator’s decision will be final, and the prevailing party is entitled to recover attorney’s fees and costs.
Mutual Non-Disparagement:
Both parties agree to communicate any concerns privately and professionally. Publicly disparaging comments about the Program, Above Health, or its representatives are not permitted.
Acknowledgment and Acceptance
By enrolling in the Program, you confirm that you have read, understood, and agree to these terms and conditions. You acknowledge that this Agreement is binding and enforceable.
Electronic signatures are accepted and enforceable.
